What is Mediation?

Mediation is a voluntary and confidential process where a neutral third party, the mediator, helps people in conflict reach a mutually acceptable agreement. Unlike going to court or arbitration, mediation is not about winning or losing. Instead, it focuses on understanding, communication, and collaboration.

About Three Birds Mediation

At Three Birds Mediation, we believe every conflict no matter how complex holds the potential for resolution. Our role is to create a calm, neutral space where individuals and organizations can find solutions with clarity and respect.

Mediation can address a wide range of disputes, including commercial, construction, workplace, professional negligence, insurance, personal injury, inheritance, and small claims. If your conflict involves two or more parties who are willing to talk, mediation may be suitable.

Most mediations can be completed within a single day or a few sessions, depending on the complexity of the issues. Compared to court or arbitration proceedings, mediation is significantly faster and more efficient.

The mediation process itself is not legally binding, so an unsuccessful attempt to mediate will not affect any party’s position in court or arbitration proceedings.  Settlement agreements are generally binding and enforceable.

Our fees are set out clearly in our Fees & Terms document. Costs are typically shared between the parties and are considerably lower than litigation expenses. We will provide a transparent cost estimate before the process begins.

Even if full settlement is not achieved, mediation often narrows the issues in dispute, improves communication, and helps parties move closer to resolution. You are always free to pursue other options, including court, if needed.
